PLEASE READ THIS USER AGREEMENT CAREFULLY BEFORE ACCESSING OR USING DARI.SHOP

This User Agreement (the “Agreement”) is a legal agreement between you (“User”, “you”, “your”) and Dari.Shop (“we”, “us”, “our”), a company incorporated under the laws of [insert your country here]. By accessing or using our services (the “Services”) through our website at www.dari.shop (the “Site”), you are agreeing to comply with and be bound by the terms of this Agreement.

1. Acceptance of Terms

1.1 By accessing, registering for, or using the Services provided by Dari.Shop, you affirm that you have read this Agreement thoroughly and attentively, understood its content, and consented to be legally bound by all its terms and conditions.

1.2 Your use of the Services represents an affirmation of your agreement to abide by the terms and conditions of this Agreement each time you access or use the Services.

1.3 If you are using the Services on behalf of a business entity, you represent and warrant that you have the necessary authority to bind that business to this Agreement and your agreement represents that such business is legally bound to this Agreement.

1.4 If at any time you find these terms and conditions unacceptable or if you do not agree to these terms and conditions, please do not use this Site or any applications that allow you to access or use the Services. We reserve the right at any time to change, add to, delete, update or modify this Agreement, simply by posting such change, update, or modification on the Site and without any other notice to you.

1.5 Each time you use the Services, the current version of the Agreement will apply. Accordingly, when you use the Services, you should check the date of this Agreement and review any changes since the last version.

1.6 By continuing to use the Services after changes to this Agreement have been published, you are consenting to the changes. If you do not agree to any changes in the Agreement as they may occur, please arrange to terminate your registration with the Site immediately and discontinue your use of the Services.

2. User Eligibility

2.1 The Services provided by Dari.Shop are intended solely for individuals who are 18 years of age or older. Any access to or use of the Services by anyone under 18 is expressly prohibited unless supervised and consented to by a parent or guardian.

2.2 By accessing or using the Services, you represent and warrant that you are at least 18 years of age and have not been previously suspended or removed from the Services by Dari.Shop. Furthermore, you attest that you have the full legal capacity to enter into a binding contract in your jurisdiction.

2.3 If you are under 18 years of age, you may use the Services only with the active involvement and approval of a parent or legal guardian who is responsible for all your activities. The parent or guardian assumes all risks associated with the minor’s use of the Services, including the transmission of content to and from third parties via the Internet.

2.4 Dari.Shop reserves the right to refuse access to the Services to anyone, at any time, for any reason, including but not limited to violation of this Agreement.

2.5 You are solely responsible for ensuring that these terms are in compliance with all laws, rules, and regulations applicable to you and the right to access the Services is revoked where these terms or use of the Services is prohibited or to the extent offering, sale or provision of the Services conflicts with any applicable law, rule or regulation.

2.6 The Services are offered only for your use, and not for the use or benefit of any third party.

3. Products

3.1 The Site is a marketplace platform that allows independent sellers to offer and sell their products directly to buyers. Dari.Shop itself does not own, control, sell, resell, provide, produce, distribute, or supply any products.

3.2 The independent sellers are solely responsible for all aspects of their products, including compliance with all laws and regulations, and the accuracy, legality, appropriateness, and quality thereof. This includes, but is not limited to, the listing of the product, the determination of the price, the description, images, safety, compliance with standards, the provision of warranties or guarantees, and the actual sale of products to buyers.

3.3 While we strive to keep the Site safe and secure for all users, we cannot guarantee the quality, safety, or legality of the products advertised, the truth or accuracy of the listings, the ability of sellers to sell items, or that a buyer or seller will actually complete a transaction.

3.4 Any information provided on the Site regarding the products sold by independent sellers is provided by the sellers and is not verified or endorsed by Dari.Shop. Therefore, we encourage users to use their judgment and exercise caution where appropriate.

3.5 Users must resolve any dispute directly with the independent seller. Dari.Shop is not obligated to resolve or intervene in any disputes between users and sellers but may do so at its sole discretion.

3.6 By using the Services, you understand and agree that Dari.Shop is not responsible for examining or warranting the listings or content provided by third-party sellers, and that you should not assume that all products are from Dari.Shop.

4. Payment Terms

4.1 All payments for products purchased on the Site must be made through the payment methods provided by Dari.Shop at the point of purchase. These may include credit cards, debit cards, bank transfers, or any other online payment methods permitted by Dari.Shop.

4.2 By making a purchase, you agree to pay the stated price (and any applicable taxes and fees) for the product in full, without any deductions unless expressly agreed otherwise in writing. You represent and warrant that all payment information provided is truthful, accurate, and you are authorized to use the payment instrument.

4.3 The full payment of the product price along with any applicable taxes and shipping costs is due at the time of purchase. No product will be dispatched to you until full payment has been received by us. In the event of non-payment, Dari.Shop reserves the right to cancel the transaction.

4.4 Dari.Shop does not charge any fees for accessing the Site. However, we reserve the right to introduce such fees in the future, subject to providing you reasonable notice.

4.5 We use third-party payment processors (the “Payment Processors”) to bill you through a payment account linked to your Dari.Shop account. The processing of payments will be subject to the terms, conditions, and privacy policies of the Payment Processors in addition to this Agreement. We are not responsible for error by the Payment Processors.

4.6 You agree to promptly update your Dari.Shop account information with any changes that may occur (for example, a change in your billing address or credit card expiration date) that may affect the processing of your payment.

4.7 All transactions are completed in the currency displayed at the time of purchase. Dari.Shop is not responsible for any charges, fees, or costs associated with foreign exchange rates or conversion.

5. Dispute Resolution

5.1 Any disagreements, conflicts, or disputes arising out of the sale or purchase of products between users and sellers should initially be dealt with directly between the involved parties. Dari.Shop strongly encourages users and sellers to communicate with each other to resolve such matters amicably before escalating to formal dispute resolution.

5.2 If the parties are unable to reach a satisfactory resolution through direct communication, the issue can be escalated to Dari.Shop’s dispute resolution service.

5.3 To use Dari.Shop’s dispute resolution service, the party initiating the dispute must submit a claim in writing to Dari.Shop detailing the nature of the dispute, the parties involved, and the resolution sought. All claims must be submitted within a reasonable time following the arising of the dispute.

5.4 Upon receipt of a dispute claim, Dari.Shop will assess the situation, and may, at its discretion, involve third parties, request further information from the parties, and take any other steps it deems necessary to facilitate the resolution of the dispute.

5.5 Dari.Shop reserves the right, but does not have the obligation, to make a final and binding decision in relation to the dispute. Any decision made by Dari.Shop is at its sole discretion and once notified to the parties, is final and must be followed by all parties.

5.6 Parties agree that the only course of action available to them to contest the decision made by Dari.Shop is to cancel their account.

5.7 Dari.Shop shall not be liable for any decisions or actions taken in response to disputes. We have no obligation to resolve any disputes.

5.8 By using our Services, you release Dari.Shop from any claims, demands, and damages arising out of disputes with other users or parties.

6. Account Termination

6.1 Dari.Shop reserves the right, in its sole discretion, without any obligation and without any notice requirement to you, to terminate or suspend your account and prohibit your access to the Services for any reason or no reason, including without limitation for any violation of this Agreement.

6.2 Such reasons may include but are not limited to: (a) breaches or violations of this Agreement or other incorporated agreements or guidelines, (b) requests by law enforcement or other government agencies, (c) a request by you (self-initiated account deletions), (d) discontinuance or material modification to the Services (or any part thereof), (e) technical or security issues or problems, (f) engagement by you in fraudulent or illegal activities, and/or (g) nonpayment of any fees owed by you in connection with the Services.

6.3 Termination of your Dari.Shop account includes: (a) removal of access to all pages within the Services, (b) deletion of your password and all related information, files, and content associated with or inside your account (or any part thereof), and (c) barring of further use of the Services.

6.4 You agree that all terminations for cause shall be made in Dari.Shop’s sole discretion and that Dari.Shop shall not be liable to you or any third party for any termination of your account, loss of your data, or access to the Services.

6.5 If you wish to terminate your account, you may do so by following the instructions on the Site or through the Services. Any fees paid to Dari.Shop are non-refundable. All provisions of this Agreement which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, and limitations of liability.

7. Limitation of Liability

7.1 To the maximum extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall Dari.Shop, its subsidiaries, affiliates, agents, officers, directors, employees, partners, or suppliers be liable to you or any third party for any special, punitive, incidental, indirect, consequential, or exemplary damages or any damages whatsoever including, without limitation, those resulting from loss of use, data, goodwill, profits, or other intangible losses, whether or not Dari.Shop has been advised of the possibility of such damages.

7.2 This includes, but is not limited to: (A) your use or inability to use the Services, (B) the conduct or content of other users or third parties on or through the Services, including without limitation, defamatory, offensive, or illegal conduct; (C) any content obtained from the Services, including incorrect or inaccurate information; or (D) unauthorized access, alteration, or use of your transmissions or content, whether based on warranty, contract, tort (including negligence), product liability, or any other legal theory.

7.3 Dari.Shop’s total liability to you for all claims relating to the Services shall not exceed the amount of fees received by Dari.Shop from you in the twelve (12) months preceding your claim (But not more than 1,600 euros).

7.4 The limitations of this section shall apply to any theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not Dari.Shop has been informed of the possibility of any such damage, and even if a remedy set forth herein is found to have failed of its essential purpose.

7.5 Some jurisdictions do not allow the exclusion of certain warranties or the exclusion or limitation of liability for consequential or incidental damages, so the limitations above may not apply to you. If this is the case, Dari.Shop’s liability will be limited to the maximum extent permitted by law. 

8. Governing Law and Jurisdiction

8.1 This Agreement and any disputes or claims arising out of or in connection with its subject matter or formation (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of Slovakia.

8.2 This Agreement expressly excludes and disclaims the terms of the U.N. Convention on Contracts for the International Sale of Goods, which shall not apply to any transaction conducted through or otherwise involving this Site or the Services.

8.3 You and Dari.Shop agree to submit to the exclusive jurisdiction of the courts located within Slovakia to resolve any legal matter arising from the Agreement. Notwithstanding this, you agree that Dari.Shop shall still be allowed to apply for injunctive remedies (or an equivalent type of urgent legal relief) in any jurisdiction.

8.4 Any cause of action or claim you may have with respect to this Site (including but not limited to the purchase of Dari.Shop products) must be commenced within one (1) year after the claim or cause of action arises, notwithstanding any statutes of limitation to the contrary.

8.5 The failure of Dari.Shop to exercise or enforce any right or provision of this Agreement shall not constitute a waiver of such right or provision. If any provision of this Agreement is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court should endeavor to give effect to the parties’ intentions as reflected in the provision, and the other provisions of this Agreement remain in full force and effect.

9. Amendments

9.1 Dari.Shop reserves the exclusive right to modify, amend, change, or replace this Agreement at any time and at its sole discretion. Changes may include but are not limited to changes prompted by legal, regulatory, or operational requirements, and changes to enhance clarity and consistency.

9.2 Any changes will be effective immediately upon posting of the revised Agreement on the Site. The “Last Updated” date at the top of this Agreement will be updated to reflect the effective date of the latest version.

9.3 Your continued access to or use of the Services following the posting of any changes constitutes your acceptance of those changes. If you do not agree to the changes, you must stop using the Services and deactivate your Dari.Shop account.

9.4 We encourage you to periodically review this Agreement to stay informed of any changes. It is your responsibility to check this Agreement regularly for changes, as continued use of the Site following the posting of changes will mean that you accept and agree to the changes.

9.5 If any future changes to this Agreement are unacceptable to you or cause you to no longer be in compliance with this Agreement, you must terminate, and immediately stop using, the Services. Your continued use of the Services following any revision to this Agreement constitutes your complete and irrevocable acceptance of any and all such changes.

9.6 No changes to this Agreement will apply retroactively unless the law requires otherwise.
